Terms of Service

These terms and conditions are understood and agreed by both parties. HostParagon is referred to below as "the Provider" and you as "the Customer". Members must accept the following terms of service of the website www.hostparagon.com:

1. The Provider reserves the right not to host the following types of website:
   1. Websites with pornographic or sexually suggestive content, sex or sexual services, including websites that link to pornographic websites.
   2. Websites related to hacking, warez, cracks, or spreading viruses, internet worms, trojans or anything else related to illegal software.
   3. Websites related to gambling of any kind.
   4. Websites offering downloads, MP3s, software, video and voice clips or online music of any kind, whether legal or illegal, including any other file extensions used to get around this rule; websites that infringe the trademarks, copyrights or intellectual property of any other person or group in any country in the world; and threats, fraud, false information, obscene content or illegal drugs.
   5. Websites offering free email, or email charged to the general public, and websites for uploading images or files of any kind.
   6. Websites offering free hosting or free web space, or hosting charged to the general public.
   7. Websites that bring the Provider into disrepute.
   8. Websites that give the Provider's system resources, such as email, web space or databases, to the general public without permission. Only activities or businesses related to the website itself are allowed. Interpretation of this clause is at the Provider's sole discretion.
2. The Provider is not a software or script provider. For questions about writing or using scripts, the Provider generally reserves the right not to answer, and may give links for you to study yourself instead. The Provider answers questions related to web hosting only. The Provider's main role is web hosting: looking after the servers so that all the features offered work as described.
3. The Provider does not allow Commercial Mass E-mailing, known as "spamming", under any circumstances. This includes sending advertising to other people's email addresses without their request or to newsgroup users, sending business email with a return address that does not exist, sending chain messages intended to generate a large number of replies, and sending the same message repeatedly to others. If detected, the service will be suspended immediately, without any refund and without prior notice.
4. Misuse of system resources: using any script or program that consumes CPU or storage space, or using mail services, mail forwarding, POP3 accounts or autoresponders that run continuously to send requests of any kind to other people's servers on the internet — known as an "attack server". Any Customer who breaches this clause agrees to be sued for damages by the Provider and by the owners of the servers on the internet in each country to which the Customer has caused damage. Such claims for damages and this offence are provided for under international internet law, and claims for damages start at USD 30,000.
5. For any activity of the Customer that breaks Thai or international law, or causes disorder concerning the nation, religion, the monarchy or society in general in any country, the Provider disclaims all responsibility for that website, will immediately stop providing service for that domain name without any refund, and may sue for the resulting damages, based primarily on the Provider's initial assessment.
6. The Provider accepts no responsibility if website data is lost for any reason, or because of equipment failure. Although we back up data every day and keep backups for 7 days, we cannot guarantee that the data will be complete and correct if equipment fails or because of any other force majeure. You should therefore always keep at least one backup copy of your own.
7. If the Customer wishes to cancel or downgrade the service before the end of the contract, the Customer is not entitled to any full or partial refund, unless the Provider cancels the service itself, in which case a reasonable refund will be given.
8. Any files the Customer uses on the server, such as website files, email files or database files, that become infected with a virus will be removed from the system automatically, without prior notice.
9. If the Customer fails to pay any fee or service charge when due, the Provider may suspend the service temporarily without prior notice.
10. If a server is damaged so that the data cannot be recovered, for whatever reason, we will refund no more than the value of the product or service you purchased from us.
11. The Provider reserves the right to suspend the service temporarily, without any prior notice, if you exceed your disk space or traffic quota, or when your service contract ends.
